Can I become a Cna if I have a criminal background?

In Florida, the answer really depends of the type of crime, how long ago it was and more.

CNA testing applicants must have a Level 2 background screening done before taking the state exam; this will show any arrests and / or convictions at the state and national level. This extensive check involves fingerprints, photo and signature, as well as verification of identity.

The state of Florida mandates background screening for all health care providers to ensure that employees do not have violent history, theft, extorsion or fraud offenses. Health care professionals often care for physically or mentally impaired patients in diferente settings, supervised and unsupervised so the state makes every effort to ensure good moral character in caregivers. Background screening exposes caregivers that have a history of violent or financial crimes, helping to protect the physical, emotional and financial interests of patients.

Felonies are more problematic. Also, having multiple misdemeanors recently can be a problem. The Board of Nursing has published guidelines that determine how criminal history is handle. The most problematic felonies that must appear before the board, regardless of time of offense:

-Category 4: Sex crimes, Child/elderly/spouse abuse, Hate crimes, violent crimes with actual harm.

-Category 5: Federal or Florida:

Fraud, drug possession/substance abuse; Medicaid/Medicare fraud.

-Category 6: Felonies in any other state, but not a federal offense: Fraud, Drug possession/substance abuse; Medicaid/Medicare Fraud.

You must apply to take the Florida CNA state exam and do the level 2 criminal background check before any decision is made. You have to pay the application fee before you find out whether you are even able to take the test. The state is not going to review the case for free. Once you register for the state exam, you get a Level 2 criminal background check. If the criminal background check comes clean, you will receive a test date in 2-3 weeks in average. If it doesn’t, you will receive a letter asking for more information and records. Any further questions should be directed to the Florida state Board of Nursing.
